Dealing with Personal Injury

by Joseph Then

Boy, did I learn a valuable lesson from my friend. He sustained an injury and cannot be compensated because he did not make an official report. What should you do if you sustain a personal injury?

Well, we will first begin by explaining to you what personal injury is. Personal injury can include an injury at work or in a traffic accident; an injury can be a result of receiving of faulty goods or services, an injury sustained by tripping over paving stones, an injury caused by errors in hospital treatment or one sustained by a victim in the course of a crime. An injury does not need to be physical, it can be psychological too.

If you have sustained personal injury, how do you go about making a complaint, asking for compensation or even asking for financial assistance? Well, if you do not know how to, you should read on.

The first thing you should do if you sustain injury is to make a report. It can be a police report. The next thing you should do is to make a report to your insurance company.

Wherever the accident happens, it should be reported to the police, employer or your insurance company. However, this depends on the kind of personal injury you sustain. If you sustain the injury at work you should first inform your employer.

Making a complaint would not be a problem but the more difficult part is asking for compensation. All you need to do when you lodge a complaint is to have your account of the accident.

The disadvantage is that they are often time consuming and the final result will be no more than an apology. If you have suffered a personal injury and you also want compensation, you should be aware that there are time limits for taking legal action and going through a complaints procedure may delay matters.

Asking for compensation should take a shorter time to process. However, if you are lodging a complaint to ask for compensation, an official account or report has to be produced. This is an especially important thing that most people forget when they want to make claims from your insurance company.

You cannot put a price on someone’s life. You also cannot put a price on someone’s body parts. This is the most difficult part of the compensation process.

If you are claiming from your insurance company there are a few things you should note. Your insurance company must pay an injured person for certain things like medical care and related expenses, income lost because of the accident, because of time spent unable to work or undergoing treatment for injuries, permanent physical disability or disfigurement and also emotional damages.

Now that you know this, I am sure you would be mentally prepared if you were to sustain personal injuries. Do make sure you are compensated accordingly.
